Terms and Conditions — Voice Mobile Safari


1. Interpretation


1.1 In this document the following terms shall have the meanings assigned to them hereunder and cognate expressions shall bear corresponding meanings, namely:
- “Voice Mobile Safari” – means Voice Mobile Safari (Pty) Limited, a limited liability company incorporated in accordance with the laws of the Republic of Botswana. UIN BW00004097141 LICENCE NO: 2022/TEL/C/107
- “Customer” – means either (i) a tour operator who contracts with Voice Mobile Safari, or (ii) a travel agent who contracts with Voice Mobile Safari on behalf of third-party travellers (the clients of such travel agent or tour operator), or (iii) a traveller/s who contracts in his/her personal capacity with Voice Mobile Safari.
- “Subcontractor” – means any person, company, natural or juristic person contracted by Voice Mobile Safari for any accommodation, activities, or associated activities forming part of the proposed, or amended itinerary.

1.2 Unless the context otherwise requires:
- Words in the singular include the plural and those in the plural include the singular.

- A reference to one gender includes a reference to the other gender.
- Where the words “include(s)”, “including”, or “in particular” are used, they are deemed to have the words "without limitation" following them.
- When any number of days is prescribed, they shall be reckoned exclusively of the first and inclusively of the last day.


2. Introduction


2.1 Voice Mobile Safari is an inbound operator and bookings agent, carrying out bookings in respect of products offered by Voice Mobile Safari and other Subcontractors to suit the Customer’s specific needs.
2.2 All bookings for services offered by Voice Mobile Safari are to be made through Voice Mobile Safari.


3. Reservations


3.1 Bookings may be made with Voice Mobile Safari by email, or via the official website.
3.2 Upon receipt of a booking enquiry, Voice Mobile Safari will send a confirmatory email acknowledging receipt of the enquiry and advising on availability. This booking is considered provisional.
3.3 Costs quoted are subject to change at any time due to fluctuations, taxes, levies, exchange rates, or other factors beyond the control of Voice Mobile Safari or its Subcontractors.
3.4 The Customer must advise, at the time of booking, the ages and dates of birth of all children (under 18) as certain lodges have age-related restrictions.
3.5 Note on Physical Ability: Many safaris and activities require a certain level of fitness and are wilderness-based. Travellers must ensure they are physically capable of participating.


4. Payment and Cancellations


4.1 A 50% deposit is required to confirm a booking; otherwise, it remains provisional and may be released without notice.
4.2 Once a booking is confirmed in writing, these Terms and Conditions apply immediately.
4.3 Full payment is due one month before the travel date.
4.4 All rates are based on a Botswana Pula base rate. Any shortfall from currency fluctuations is the Customer’s responsibility.
4.5 Voice Mobile Safari reserves the right to refuse services to any traveller if payment has not been received.
4.6 Cancellations depend on Subcontractors’ policies and must be made in writing. Confirmation of receipt is required for validity.
4.7 Date changes will incur administrative or cancellation fees depending on Subcontractor policies.
4.8 Voice Mobile Safari reserves the right to cancel tours without compensation if a participant endangers others’ safety.


5. Refunds


5.1 Refunds may be made only if a trip is cancelled by the operator under valid circumstances (e.g. road accidents).
5.2 No refunds for no-shows or unused services.
5.3 Handling and cancellation fees apply to any refunds.


6. Insurance


6.1 Travellers are solely responsible for obtaining comprehensive travel insurance.
6.2 Voice Mobile Safari shall not be liable for:
- Personal or cancellation insurance, or items of a personal nature.
- Filing or prosecuting insurance claims.
- Claims rejected by insurers.
6.3 Travellers must confirm medical fitness before travel.
6.4 Pre-existing medical conditions must be disclosed.
6.5 Travellers must take precautions against malaria or other diseases as applicable.
6.6 It is the traveller’s responsibility to comply with vaccination and health requirements.


7. Passport and Visas


7.1 Travellers are responsible for ensuring possession of valid passports, visas, re-entry permits, and other required travel documents.
7.2 Voice Mobile Safari accepts no responsibility for any consequences of non-compliance.
7.3 Travellers intending to drive rental cars must hold an international driving permit and a valid local licence.


8. Exclusion of Liability, Suppliers’ Terms and Risk


8.1 While Voice Mobile Safari endeavours to engage reliable Subcontractors, it has no direct control over their operations.
8.2 Voice Mobile Safari is not liable for loss, damage, injury, delays, or irregularities caused by Subcontractors.
8.3 Voice Mobile Safari shall not be liable for:
- Delays or omissions due to technical issues, weather, or other causes beyond its control.
- Cancellations or curtailments due to Customer circumstances.
- Additional costs arising from unscheduled changes.
8.4 Voice Mobile Safari may cancel or alter tours if conditions (e.g. unrest, weather, strikes) make continuation unsafe.
8.5 Bookings are subject to Subcontractors’ terms and conditions.
8.6 Voice Mobile Safari’s liability, if found applicable, shall not exceed P50,000.00 (Fifty Thousand Pula).
8.7 Voice Mobile Safari reserves the right to use photographs taken during tours for promotional purposes.
8.8 All Customers must sign indemnity forms (parents/guardians for minors).
8.9 Voice Mobile Safari reserves the right of admission.
8.10 Confirmation of booking constitutes acceptance of these terms.


9. Luggage


9.1 Luggage allowance is 15–20 kg per person for land/water safaris and 12 kg per person for light aircraft.
9.2 Excess luggage may incur extra costs or be left behind.
9.3 No refunds will be provided for missed charters due to luggage excess.
9.4 Only soft bags are permitted; hard cases with wheels are not accepted.


10. General Terms


10.1 Voice Mobile Safari shall not be bound by any representations not recorded in this document.
10.2 Each term herein is severable; invalid terms do not affect the rest.
10.3 No indulgence granted by Voice Mobile Safari constitutes a waiver of rights.
10.4 Customers must obey all instructions issued by Voice Mobile Safari and its Subcontractors.
10.5 Neither party shall be liable for breaches arising solely from force majeure events.
10.6 Neither party may assign obligations without written consent.
10.7 This document constitutes the entire agreement between the Customer and Voice Mobile Safari.
10.8 This agreement shall be governed by the laws of the Republic of Botswana.
10.9 Any disputes shall be resolved through arbitration under the Botswana Institute of Arbitrators (BIARB), whose decision will be final and binding.
10.10 Arbitration shall be conducted confidentially.
10.11 These terms are effective immediately upon booking confirmation.
